1. Scope
These terms govern your use of the villatracker.com website and the Villa Tracker platform at login.villatracker.com, operated by Villa Tracker, a business of Smiling House Ltd ("Villa Tracker", "we", "us"). By registering for or using the website or platform you accept these terms. Terms for bookings made on behalf of your clients are set out separately in our Booking Terms; terms for professional travel partners are set out in the Travel Partner Agreement.
2. Accounts
The platform is intended for travel professionals and companies. When registering, you agree to provide accurate and complete information and to keep it up to date. You are responsible for all activity under your account and for keeping your login credentials confidential. We may review, suspend or close accounts that are inaccurate, inactive or used in breach of these terms.
3. Platform content
Villa Tracker presents a curated portfolio of privately owned holiday properties. Property descriptions, imagery, amenities, availability and indicative rates are provided with care but may change and do not constitute a contractual offer. A stay is only confirmed under the Booking Terms once expressly confirmed by us in writing.
Displayed prices may be converted into your selected currency for convenience using recent exchange rates; the contractual price and currency are stated in your quote or booking confirmation.
4. Acceptable use
When using the website or platform you agree not to:
- Use the website or platform for any unlawful purpose or in breach of these terms.
- Scrape, harvest or systematically extract content, listings, rates or imagery without our written permission.
- Share your account access with third parties outside your company.
- Interfere with the operation, security or availability of the website or platform.
- Submit false or misleading information, or third-party personal data you are not entitled to share.
5. Intellectual property
The website and platform, including their design, text, imagery, logos, software and databases, are protected by copyright and other rights held by Villa Tracker, our property owners and partners, or their respective licensors. You may use content from the platform to prepare proposals for your own clients; any other reproduction or distribution requires our prior written consent.
6. Liability
The website and platform are provided "as is". To the extent permitted by law, we exclude liability for damage arising from their use, from temporary unavailability, or from third-party websites we link to. Mandatory liability for gross negligence, wilful misconduct and personal injury remains unaffected.
7. Changes to these terms
We may update these terms from time to time. The version published at the time of your use applies; the latest revision date appears at the top of these terms.
8. Governing law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-law rules. The exclusive place of jurisdiction is Gstaad, Switzerland, subject to any mandatory statutory forum.
